Overview
Each time Del Taco opens a new Del Taco restaurant, Del Taco may offer the 10,000 Del Taco Giveaway (the “Giveaway”) as part of the grand opening celebration. Each time Del Taco offers the Giveaway the first 100 eligible guests who visit the restaurant will receive the offer during the specified time. The exact Del Taco locations participating in the Giveaway, the quantity of Del Taco locations participating in the Giveaway and the exact date, time and location of each Event will be determined by Del Taco Restaurants, Inc., in their sole discretion. There is no guarantee that all new Del Taco Restaurants will offer the promotion. The promotion will only be offered at a new Del Taco Restaurant if it is announced in local media, or by visiting deltaco.com/FreeTacoSociety.
Eligibility
The offer is open to legal United States residents with a valid government issued photo ID who are 18 years of age or older. Employees, officers, and directors of Del Taco Restaurants, Inc., and their respective affiliated companies, subsidiaries, distributors, suppliers, retailers, printers, advertising, and promotion agencies, and any and all other companies associated with the design or execution of this Giveaway (collectively, “Released Parties”), and the members of the immediate families (spouse, parent, sibling and child and their respective spouses, regardless of where they reside) or households of any of the above, whether or not related, are not eligible to participate.
Prizes
One hundred (100) prizes will be available during the Giveaway. The prize consists of two (2) free Del Tacos per week for up to fifty-two (52) weeks. The offer will be awarded in the form of fifty-two (52) promotional codes that will be distributed through the Del Taco mobile app. Participants must download and sign up for the Del app to receive the Giveaway. The Giveaway will be distributed via the Del app on a weekly basis. Each weekly Giveaway will be valid for (1) one week following the date of issue. Approximate Retail Value (ARV) $155 of all prizes; however, ARV may vary based on geographical region. Del Taco’s determination as to the order of participants to visit each Event location will be final. Limit one (1) free Del Taco Giveaway per person and per household for the entire offer period. The Giveaway is only valid at the Restaurant that provided the promotion code for the 10,000 FREE Del Taco Promotion Giveaway. Two free Del Tacos offer may not be used at any location other than the restaurant that issued the promotional code.
General Conditions
Recipients must show valid, government issued photo identification to receive the Giveaway. The total value of all fifty-two (52) promotional codes is based on redemption of one hundred and four (104) The Del Tacos throughout the given year. Promotional codes are only to be redeemed at the Restaurant of issuance and will void upon each use. Promotional codes expire in seven (7) days following distribution. Any unused balance will not be awarded after (7) days following distribution of the promotional code. The Giveaway may not be used online or in conjunction with any other offer or discount. Valid only in the U.S.A. and is void where prohibited.
General Rules: Giveaway recipients must comply with all venue rules and regulations. Del Taco reserves the right to disqualify any individual from participating in this Giveaway if his/her behavior at an applicable Event is deemed to be disruptive, aggressive, violent, offensive or uncooperative in any way, as determined by Del Taco in their sole discretion. This Giveaway may not be used in combination with any other offer, discount, or coupon. By participating in this Giveaway, participants agree to the terms and conditions of this Giveaway and agree to abide by and be bound by these terms and agreements and the decisions of Del Taco, which shall be final and binding in all matters relating to this Giveaway. In the event a participant is found to be in violation of any of these terms or conditions, he/she will be required to reimburse Del Taco for the stated value of the tacos. Persons who tamper with or abuse any aspect of the Giveaway, as solely determined by Del Taco, will be disqualified. Should any portion of the Giveaway be, in Del Taco’s sole opinion, compromised by non-authorized human intervention or other causes, which, in the sole opinion of Del Taco, corrupt or impair the administration, security, fairness of this Giveaway, Del Taco reserves the right at its sole discretion to terminate this Giveaway. Valid only to individual consumers.
Release
By participating, participant further agrees to release and hold Released Parties harmless from and against any and all claims, losses, damages, injury, harm and liability of any kind arising from or in connection with, in whole or in part, directly or indirectly, the acceptance, possession or use/misuse of any item provided (including any travel/activity related thereto), the administration of the Giveaway, participation in the Giveaway or in any offer-related activities and participant assumes all liability in connection therewith.
Limitation of Liability
Except where prohibited, the participants agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Giveaway, or any prize awarded, or the determination of a winner, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) under no circumstances will the participants be permitted to obtain awards for, and the participants hereby waive any and all rights to claim punitive, incidental, consequential, and any other damages, other than for actual out-of-pocket expenses and participants hereby waive any and all rights to have damages multiplied or otherwise increased.
Agreement to Official Rules
By participating in the Giveaway, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Del Taco (including but not limited to Del Taco’s employee(s) handling prize awards), which are final and binding in all matters relating to the promotion. By participating in the Giveaway, each participant waives any right to claim ambiguity in these Official Rules. The failure or delay by Del Taco in enforcing any particular clause, provision, or aspect of these Official Rules shall not impact the validity, enforceability, or effect of such clause, provision or aspect, or any other clause, provision, or aspect of these Official Rules.
Choice of Law
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the participants and/or Sponsor in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of California without regard to conflicts of law/choice of law doctrine of California or any other jurisdiction, and all proceedings shall exclusively take place in the United States District Court for the Central District of California, or California State Court located in Orange County, California. The participants agree to the jurisdiction of such courts and waive any right to change of venue or any like right.
